Saxophonist James Moody dies of pancreatic cancer

SAN DIEGO – Jazz saxophonist James Moody is best known for his 1949 “Moody’s Mood for Love,” but when he recorded the hit that eventually was elected into the Grammy Awards’ Hall of Fame, he said, he was just “trying to find the right notes.”

“People later said to me: ‘You must have been very inspired when you recorded that.’ And I said: ‘Yeah I was inspired to find the right notes!’” Moody told the San Diego Union-Tribune in February.

The song later was recorded by Aretha Franklin, Van Morrison, Amy Winehouse and others. Longtime fan and confidante Bill Cosby called it a “national anthem.”

Moody, who recorded more than 50 solo albums as well as songs with the likes of Dizzy Gillespie and B.B. King, died Thursday at San Diego Hospice after a 10-month battle with pancreatic cancer, his wife said. He was 85.

“James Moody had a sound, an imagination and heart as big as the moon. He was the quintessential saxophone player, and his ‘Moody’s Mood for Love’ will forever be remembered in jazz history side by side with Coleman Hawkins’ classic ‘Body and Soul,’” friend and collaborator Quincy Jones said in a statement Thursday. “Today we’ve lost not only one of the best sax players to ever finger the instrument, but a true national treasure.” Read more…

US judge: Music website violated Beatles copyrights

LOS ANGELES — A website that sold songs by The Beatles for 25 cents more than a year before legal digital copies were available is liable for copyright infringement, a federal judge has ruled.

US District Judge Josephine Staton Tucker ruled Wednesday that BlueBeat.com violated the copyrights and presented unfair competition to music company EMI Group and others. The site streamed and sold music by the Fab Four and other top-name acts, including Coldplay and Lily Allen, for several days before music companies sued to shut it down in November 2009.

The ruling did not address how much damages BlueBeat may be liable for, although EMI’s attorneys have noted that it began streaming and selling Beatles music shortly after the release of a re-mastered box set of all the group’s albums last year.

In court filings, the site acknowledge it had distributed more than 67,000 Beatles songs before another federal judge issued a preliminary injunction that temporarily shut down the site.

With great fanfare, Beatles music became available on Apple’s iTunes on Nov. 16, and in the first week more than two million of their songs and 450,000 albums were purchased. The popular music service sells the group’s songs for $1.29 apiece. Read more…

Review: ‘The Tourist’

The romantic action caper is a genre that can seem almost decadent in its clockwork jauntiness — its frantic, overstuffed eagerness to please. “The Tourist,” starring Angelina Jolie as a hip-swiveling British agent fatale and Johnny Depp as the innocent American math teacher she ropes into posing as her underworld lover, is an attempt to take the stuffing out of the genre.
Most of the familiar elements are here: guns, gangsters, surveillance teams, vehicular crack-ups, mistaken identities. The star wattage, in theory, could hardly get much hotter. This time, however, the director is Germany’s Florian Henckel von Donnersmarck, doing his first Hollywood production after the art-house smash “The Lives of Others” (2007), his lacerating tale of political oppression in East Germany.

Henckel von Donnersmarck sets “The Tourist” in the ornate decaying maze of Venice, where he plays down the ultraviolence and mission-improbable stunt work. When Depp, pursued by the world’s most inept Russian henchmen, scampers across the city’s fragile tiled rooftops, he’s wearing pajamas, and the little leaps he takes are (intentionally) more pedestrian than death-defying.
“The Tourist” has a relaxed, at times ramblingly archaic tone (we’re not talking Hitchcock — we’re talking “Silver Streak”). It sidesteps the aggressive, wham-bam tone of cheeky-violent romps from “The Mexican” to “Knight and Day.” Unfortunately, it doesn’t come up with a whole lot to replace that energy. Black Eyed Peas’ album debuts at No. 6

Hopefully the Black Eyed Peas aren’t too salty about their latest album’s record sales – the super-group arrived at No. 6 on the Billboard 200 albums chart with their latest effort, “The Beginning.”

Although there was incentive to snag a copy of the ensemble’s album, since fans could win a chance to see the Peas perform live during their halftime performance at the Super Bowl XLV, the record sold 119,000 copies, according to Nielsen SoundScan.

Billboard speculates that the lower-than-last-time debut could have something to do with the middling reception to the album’s single, “The Time (Dirty Bit).” Comparatively, when the group’s last album, “The E.N.D.,” debuted at No. 1 on the Billboard charts in June, 2009, their single “Boom Boom Pow” was enjoying its 11th week as the top single on the Billboard Hot 100.

Yet the group’s still faring better than others – Soulja Boy of “Crank Dat” and “Pretty Boy Swag” fame has sold only 13,000 copies of his latest album, “DeAndre Way.” Read more…
